These terms are available in German, English, French and Italian. The German version is binding.
1. What this is about
OpenVolley and OpenBeach are electronic scoresheets for volleyball and beach volleyball. They are run by Luca Canepa as a private person (contact and address in the legal notice). These terms apply to the use of the websites under *.openvolley.app, the server and the accounts ("the services"). By using the services you accept these terms.
2. Free software, free of charge
The software is free software under the GNU General Public License, version 3 or later (GPL-3.0-or-later). The software itself, its source code and your rights in it are governed by that licence alone; these terms do not restrict it. The source code is at https://github.com/Lucanepa/openvolley and https://github.com/Lucanepa/openbeach.
The services are free of charge. There is no right to use them.
3. Account
- You need an account to sync, to manage teams and tournaments and to approve results. Without an account you can use the apps offline.
- Give truthful details. An account belongs to one person and must not be shared.
- Keep your password and your approval PIN secret. An approval with your PIN counts as your confirmation of the result. Report misuse at once to support@openvolley.app.
- New accounts start without a role. Roles (for example scorer, referee, competition manager) are granted by an administrator or by an invite code. Invite codes are meant for the person or club they were issued to and must not be passed on.
- If you are under 16, you need the consent of a parent or other legal representative for an account.
- You can delete your account in the app at any time. What remains afterwards is described in the privacy policy.
- I can withdraw roles and suspend or delete accounts that break these terms or endanger the security of the services.
4. Official matches
- The scorer is responsible for keeping the scoresheet correctly, just as with a paper scoresheet.
- Whether OpenVolley may be used for an official match, and how the scoresheet must be submitted, is decided by the association or the organiser of the competition. Check this before the match.
- For official matches, keep a fallback ready (for example a paper scoresheet) in case a device fails.
- The apps support the rules of the game but do not replace the referees' decisions. The official rules and regulations prevail.
5. Data you enter
- Anyone who enters data about other people (rosters, team staff, officials, tournament teams) must be entitled to do so. Clubs, organisers and team managers are responsible for informing the people concerned, and for minors their parents, that their data is recorded on the scoresheet.
- Enter only data that the scoresheet or the tournament needs.
- You keep your rights in your content. You allow me to store, process, back up and display the data as the services need and as described in the privacy policy, for example team names and the score in the public livescore or names on public tournament pages.
- Closed scoresheets are official records. They remain even after an account is deleted (see the privacy policy).
6. Acceptable use
In particular, you may not:
- use the services for unlawful purposes or create false scoresheets;
- get around PINs, roles or other safeguards, or use other people's accounts;
- attack or overload the services, or retrieve data automatically on a large scale;
- enter or spread other people's data without being entitled to.
If you find a security issue, please report it confidentially to support@openvolley.app before making it public.
7. Availability
I run the services to the best of my ability but without promising any particular availability. Maintenance, faults or changes can interrupt the services. I may change or discontinue services. The apps keep working offline; back up important scoresheets yourself (the apps let you download backup copies and scoresheets for this).
8. Warranty and liability
As described in the GPL, the software is provided without warranty. For the services, too, I give no warranty to the extent the law allows. My liability is excluded to the extent permitted by law. This does not apply to damage I cause intentionally or through gross negligence, nor to any other liability that cannot be excluded under mandatory law.
9. Changes
I may update these terms. The new version applies from its publication on this page. If you keep using the services afterwards, this counts as acceptance. If you do not agree, you can delete your account.
10. Governing law and place of jurisdiction
Swiss law applies. The place of jurisdiction is Zürich, Switzerland. Mandatory places of jurisdiction, for example for consumers, remain reserved.
If any provision is invalid, the others remain in force.
